Las vías legales de protección en materia de traslado legal de los niños, niñas y adolescentes

Abstract

En virtud del actual proceso migratorio que experimenta Venezuela desde el Centro de Clínica Jurídica de la UCAB, se evidencia el desconocimiento que existe en la sociedad de los procedimientos legales que se deben seguir para proteger los derechos de los niños, niñas y adolescentes, lo cual se traduce en el uso y abuso de la figura del poder como supuesta “vía legal”, siendo la finalidad de este artículo será aclarar cuáles son las figuras jurídicas que establece la LOPNNA para el caso del traslado de los niños, niñas y adolescentes o para la permanencia de los mismos sin sus padres y/o representantes legales.

Under the current migratory process that Venezuela is experiencing, an obvious situation has emerged: many children and adolescents are left behind, therefore they are staying in Venezuela without their parents or legal guardians. We have been able to appreciate,through the UCAB Legal Clinic Center, that there is lack of knowledge in the society regardingthe legal procedures that must be followed to protect the human rights of such children and adolescents. The consequence of this situation is the abuse of the figure of powers or attorney towrongly fulfill such “legal procedure”, therefore the purpose of this article is to inform the legal figures established by the LOPNNA in case of children and adolescents leaving the country or when they have permanency in Venezuela without their parents or legal guardian.
