La perspectiva de los niños, niñas y adolescentes sobre el sistema judicial y la violencia armada: un estudio cualitativo

Abstract

El propósito de esta investigación cualitativa fue documentar y analizar la perspectiva de niños, niñas y adolescentes sobre el sistema de justicia venezolano y las oportunidades de protección que les ofrecen sus comunidades. La recolección de datos incluyó 4 grupos focales y 42 participantes, realizadas en los municipios Libertador y Valencia del estado Carabobo, durante el mes de junio de 2017. Los resultados reflejan el contexto de emergencia humanitaria que afecta al país, y evidencian la operación de bandas armadas que cometen asesinatos y otros crímenes con total impunidad, así como la captación de niños y jóvenes por parte de tales bandas. También evidencian la profundización de la pobreza; el debilitamiento de las familias en todos sus roles de manutención, protección y socialización de los hijos; la ausencia de programas o servicios de apoyo; el precario funcionamiento del Sistema de Protección; la frecuencia de situaciones de abandono, explotación y violencia; y una marcada desconfianza ante el sistema de justicia. Al respecto resalta que, a pesar de su corta edad, nuestros informantes han sido testigos de graves violaciones de la ley por parte de los cuerpos policiales, y tienden a considerar como normales o hasta positivas diversas formas de violencia ilegal, incluyendo los ajusticiamientos y linchamientos, porque se supone que estas serían formas de “proteger” a la comunidad.

The purpose of this qualitative study was to document and analyze the point of view of boys, girls and adolescents about the judiciary system and about the protection opportunities provided to them by their communities. Data recollection included 4 focus groups and 42 participants, conducted in the Libertador and Valencia municipalities of Carabobo State, on June 2017. Results reflect the humanitarian emergency currently affecting the country, and reveal the existence of armed gangs that have committed a number of homicides and other crimes with complete impunity, as well as the recruitment of kids and youngsters to form part of those gangs. Results also show increased poverty; the weakening of families in terms of all its roles: subsistence, protection and socialization; the absence of support programs or services; the poor performance of the Protection System; frequent situations of abandonment, exploitation and violence; and a pronounced mistrust of the judiciary system. In spite of their tender age, the majority of our informants have witnessed grave law violations committed by the police forces, and usually deem diverse forms of illegal violence, including executions and lynch mobs, as something normal or even positive, since these are supposed to be waysof “protecting” the community.
