COVID-19: entre el Derecho Penal y la Bioética Jurídica

Abstract

La pandemia del COVID-19 gestó una crisis relevante en ámbito de la salud, y dio lugar a diversas acciones de los gobiernos que a su vez despertaron diversas reacciones, entre ellas las de rechazo por considerar que eran ilegítimas por violar derechos humanos. Un examen desde el ángulo bioéticojurídico mediante el principio de la justicia distributiva puede contribuir a proponer una respuesta frente a esas medidas y las respectivas reacciones.

The Covid-19 pandemic generated a significant crisis for the healthcare sector and gave rise to a varied set of governmental actions which in turn led to diverse reactions, including their rejection because they were seen as illegitimate violations of human rights. An analysis based on the legal bioethical perspective, focusing on distributive justice, can contribute to a response, both to the governmental measures and the reactions to them.
