Visión garantista del ecuador en las formas de contratación laboral para el ingreso al servicio público

Abstract

La investigación tiene como objetivo general analizar las formas de contratación laboral para el ingreso al servicio público en el Ecuador de acuerdo con la Ley Orgánica de Servicio Público y su reglamento desde la visión garantista del Estado. La relevancia del estudio se orienta en la determinación sobre si ambas normas guardan armonía con lo dispuesto en la Constitución de la República del Ecuador texto que garantiza en las distintas modalidades de ingreso al servicio público el derecho a la estabilidad laboral. Su desarrollo corresponde a una investigación documental basada en el análisis de datos obtenidos de fuentes bibliográficas. Los resultados del análisis contribuyeron en la identificación de las modalidades de ingreso y la relación entre distintas formas de contratación laboral para acceder al servicio público en la Administración Pública. La conclusión es que las modalidades de ingreso al servicio público no garantizan, en igualdad de condiciones, el derecho a la estabilidad laboral lo cual atenta con la visión del Estado constitución de derechos y justicia, para lo cual es necesario articular todas las leyes y reglamentos que rigen el ingreso de los funcionarios al servicio público con los parámetros democráticos dispuestos en el texto fundamental de la nación

The general objective of the research is to analyze the forms of laborcontracting for entry to public service in Ecuador in accordance with theOrganic Law of Public Service and its regulations from the guaranteeistvision of the State. The relevance of the study is oriented in determiningwhether both norms are in harmony with the provisions of the Constitution ofthe Republic of Ecuador, a text that guarantees the right to job stability in thedifferent modalities of entry into public service. Its development correspondsto a documentary research based on the analysis of data obtained frombibliographic sources. The results of the analysis contributed to theidentification of the entry modalities and the relationship between differentforms of labor contracting to access the public service in the PublicAdministration. The conclusion is that the modalities of entering the publicservice do not guarantee, under equal conditions, the right to job stability,which undermines the vision of the State, constitution of rights and justice,for which it is necessary to articulate all laws and regulations that govern theentry of civil servants into public service with the democratic parameters setforth in the fundamental text of the nation
