Autoría mediata por dominio de la voluntad de unAdolescente: ¿Inimputabilidad o responsabilidad penal?

Abstract

La reflexión académica-jurídica se centra en destacar aspectos relacionados con la autoría mediata por dominio de la voluntad del adolescente en la comisión de una infracción penal de las contenidas en el Código Orgánico Integral Penal en vigor, lo que permitió fijar una posición acerca de si estos deben ser declarados inimputables o responsables penalmente. La relevancia de esta investigación se asienta en la revisión de algunos elementos teóricos-doctrinarios en la discusión sobre el tema de la autoría mediata y de la voluntad, tópicos que generan importantes debates en el campo penal, ya que para una parte de la doctrina la incorporación de esta figura llenó un vacío legal en aquellos casos en los cuales la persona que cometía de manera directa el delito no actuaba por voluntad propia sino de un tercero que, por medio del engaño, intimidación o coacción lograba que este realizara el hecho antijurídico, mientras que para los otros, será menester comprobar que no hubo tal voluntad por el sujeto que realiza la acción, lo cual requiere de un examen sobre la capacidad del adolescente, conforme lo dispone el texto integral penal y el Código de la Niñez y Adolescencia. Los resultados de esta discusión nos llevan al campo filosófico-jurídico ya que la identificación de esta figura invita a reflexionar sobre la relación de poder, donde juega un papel relevante el tema de la subordinación de los adolescentes como sujetos en desarrollo frente a la figura de autoridad. La conclusión del estudio es que el operador de justicia antes de declarar la responsabilidad penal de un adolescente debe estimar el cumplimiento de los extremos que impone la autoría mediata por dominio de la voluntad para evitar sentencias erráticas que generen impunidad o por el contrario la vulneración del principio de culpabilidad

The academic-legal reflection focuses on highlighting aspects related tomediate authorship by domain of the adolescent's will in the commission of acriminal offense contained in the current Comprehensive Criminal OrganicCode, which allowed to establish a position about whether these must bedeclared unimputable or criminally responsible. The relevance of thisresearch is based on the review of some theoretical-doctrinal elements in thediscussion on the issue of mediate authorship and will, topics that generateimportant debates in the criminal field, since for a part of the doctrine theincorporation of this figure filled a legal vacuum in those cases in which theperson who directly committed the crime did not act of his own free will butof a third party who, through deception, intimidation or coercion managed tomake him carry out the unlawful act, while for the others, it will be necessaryto verify that there was no such will by the subject carrying out the action,which requires an examination of the adolescent's capacity, as provided for inthe comprehensive criminal text and the Code for Children and Adolescents The results of this discussion lead us to the legal-philosophical field since theidentification of this figure invites us to reflect on the power relationship,where the issue of the subordination of adolescents as subjects indevelopment plays a relevant role in front of the figure of authority. Theconclusion of the study is that the justice operator, before declaring thecriminal responsibility of an adolescent, must estimate compliance with theextremes imposed by mediate authorship by control of the will to avoiderratic sentences that generate impunity or, on the contrary, the violation ofthe guilt principle
