La sustracción de efectos pertenecientes a las fuerzas armadas y el derecho penal del enemigo

Abstract

El objeto de esta investigación es analizar la sustracción de efectos pertenecientes a la fuerza armada como expresión concreta del derecho penal del enemigo en la legislación venezolana, a los fines de contrarrestar su efecto dañoso, bajo el enfoque de la criminología crítica, analizando la normativa establecida en el Código Orgánico de Justicia Militar, en concordancia con lo dispuesto en la Constitución de la República Bolivariana de Venezuela. La metodología utilizada es la documental. Se toma en consideración las decisiones que han surgido en la Jurisdicción Penal Militar en relación al tema. Se concluye que el delito de sustracción de efectos pertenecientes a la fuerza armada se manifiesta en una modalidad agravada por cuanto los objetos sustraídos en su mayoría material de guerra, son vendidos a grupos paramilitares o de guerrillas en las fronteras venezolanas, existiendo la necesidad de reformar el Código Orgánico de Justicia Militar en relación a este delito

It isconcluded that the crime of theft of effects belonging to the armed forcemanifests itself in an aggravated modality because the stolen objects, mostlywar material, are sold to paramilitary or guerrilla groups on the Venezuelanborders, and there is a need to reform the Organic Code of Military Justice inrelation to this crime
