Los animales como personas no humanas sujetos dederecho: ¿Nuevo paradigma filosófico-jurídico?

Abstract

El artículo científico tiene como propósito reflexionar acerca de los animales como personas no humanas sujetos de derecho, estimando el nacimiento de un nuevo paradigma filosófico-jurídico que surge a partir del reconocimiento que realiza la Constitución de la República del Ecuador de la naturaleza como titular de derechos y de las decisiones que se han dictado en el mundo en este sentido, y que han tomado como base lo dispuesto en el contexto jurídico ecuatoriano. La investigación es de carácter crítico-reflexivo donde se intenta dar respuestas a un conjunto de incógnitas que han guiado el estudio. El presente análisis buscará más que encontrar respuestas, plantear las preguntas adecuadas y revisar en qué medida en los órdenes axiológicos del hombre se encuentra el respeto a las otras especies vivas y determinar si el “animalismo” y el “humanismo” son compatibles. El estudio reconoce los aportes de la doctrina y la jurisprudencia especializada para desentrañar la necesidad de consolidar este nuevo paradigma que impactará definitivamente la forma de asumir las relaciones jurídicas. La conclusión es que esta novísima categoría de la persona no humana titular de derechos conlleva la construcción de un enfoque o prototipo jurídico que logre honrar el mandato constitucional que se alza como un aporte para el derecho universal contemporáneo reconociendo si caminamos hacia una consciencia moral superior o simplemente nos hemos llenado de declaraciones vagas, que no se materializan en lo esencial

The purpose of the scientific article is to reflect on animals as non-humanpersons subject to law, estimating the birth of a new philosophical-legalparadigm that arises from the recognition that the Constitution of theRepublic of Ecuador makes of nature as holder of rights and the decisionsthat have been issued in the world in this regard, and that have taken as abasis the provisions of the Ecuadorian legal context. The research is of acritical-reflective nature where it tries to give answers to a set of unknownsthat have guided the study. This analysis will seek more than findinganswers, asking the right questions and reviewing to what extent respect forother living species is found in the axiological orders of man and determiningwhether "animalism" and "humanism" are compatible. The study recognizesthe contributions of doctrine and specialized jurisprudence to unravel theneed to consolidate this new paradigm that will definitely impact the way ofassuming legal relationships. The conclusion is that this newest category ofthe non-human person who owns rights entails the construction of a legalapproach or prototype that manages to honor the constitutional mandate thatstands as a contribution to contemporary universal law, recognizing whetherwe are moving towards a higher moral conscience or we have simply filledourselves with vague statements, which do not materialize in the essentials
