Consideraciones legales y constitucionales sobre accidentes de tránsito en Ecuador: Un estudio de revisión

Abstract

La siniestralidad vial en Ecuador representa una problemática crítica en el ámbito de la seguridad ciudadana. De acuerdo con el Instituto Nacional de Estadísticas y Censo (INEC, 2024), el país ha experimentado un aumento constante en el número de accidentes de tránsito. Este incremento ha implicado también un alza en las personas lesionadas y fallecidas, lo que refleja una preocupación creciente respecto al impacto de los accidentes en el bienestar público y la seguridad. Por tanto, este estudio de revisión aborda las consideraciones jurídicas y constitucionales que subyacen en el tratamiento de los accidentes de tránsito en Ecuador, con énfasis en el equilibrio entre el poder punitivo del Estado y la protección de los derechos de los involucrados. Se analizan normativas, estadísticas oficiales y estudios teóricos que exploran el proceso penal de tránsito, el cual, constituye un mecanismo clave en la protección de los derechos ciudadanos. Este análisis se enfoca en la aplicación de principios constitucionales de equidad, proporcionalidad y respeto a los derechos humanos en cada fase procesal, desde la investigación hasta la resolución judicial. Se concluye que, a través de un sistema penal garantista, el Ecuador no sólo busca sancionar los delitos viales, sino también promover una cultura de responsabilidad y respeto a las normativas de tránsito

Traffic accidents in Ecuador represent a critical issue within the realm of public safety. According to the National Institute of Statistics and Census (INEC, 2024), the country has experienced a steady increase in the number of traffic accidents. This rise has also led to a growth in the number of injured and deceased individuals, reflecting growing concern regarding the impact of accidents on public safety and well-being. Therefore, this review study addresses the legal and constitutional considerations underlying the handling of traffic accidents in Ecuador, emphasizing the balance between the State’s punitive power and the protection of the rights of those involved. Relevant regulations, official statistics, and theoretical studies exploring the criminal process related to traffic incidents areanalyzed, highlighting this process as a key mechanism for the protection of citizens’ rights. This analysis focuses on the application of constitutional principles of fairness, proportionality, and respect for human rights in each procedural phase, from investigation to judicial resolution. It is concluded that, through a rights-protective criminal justice system, Ecuador seeks not only to penalize traffic-related offenses but also to promote a culture of responsibility and adherence to traffic regulations
