Violência doméstica e familiar contra mulheres trans: insuficiência legal ou má interpretação? Uma análise sob a perspectiva da Teoria Feminista

Abstract

A Lei nº 11.340/2006 surgiu como instrumento de prevenção e repressão de violências praticadas contra mulheres em razão de seu gênero. No entanto, existem posicionamentos judiciais e debates legislativos sobre o objetivo do termo inserido na legislação, sendo questionado sobre quais mulheres a lei se refere. Por essa razão, importa uma análise dos conceitos de sexo e gênero, a partir da teoria feminista, além da breve apresentação de Projeto de Lei que pretende definir o conceito de gênero, bem como da decisão recente do Superior Tribunal de Justiça, que, por sua vez, foi favorável à aplicação da Lei às mulheres trans. Sendo assim, este trabalho pretende, a partir de revisão bibliográfica, identificar referenciais teóricos para classificação de conceitos e categorias que expliquem a (in)adequação da Lei aos casos de violências contra mulheres trans. Será má interpretação ou de fato a Lei é insuficiente para proteção dessas mulheres?

Law nº 11.340/2006 emerged as an instrument for the prevention and repression of violence against women based on their gender. However, there are judicial positions and legislative debates about the purpose of the term inserted in the legislation, being questioned about which women the law refers to. For this reason, it is important to analyze the concepts of sex and gender, based on feminist theory, in addition to the brief presentation of a Bill that intends to define the gender’s concept, as well as the recent decision of the Superior Court of Justice, which, in turn, was in favor of applying the Law to trans women. Therefore, this work intends, based on a bibliographic review, to identify theoretical references for classifying concepts and categories that explain the (in)adequacy of the Law in cases of violence against trans women. Is it a misinterpretation or is the Law actually insufficient to protect these women?
