La teoría de la unidad del título de imputación: un análisis Comparativo de sus efectos en el derecho penal

Abstract

La presente investigación aborda un problema jurídico relevante en el ámbito penal: la diversidad de interpretaciones de la teoría de la unidad del título de imputación y su impacto en la resolución de casos relacionados con infracciones de deber en distintas jurisdicciones. La relevancia de este estudio radica en que las interpretaciones divergentes pueden afectar la administración de justicia y generar inseguridad jurídica. El objetivo principal del artículo es evaluar dichas interpretaciones doctrinales y su influencia en los procesos judiciales. Para ello, se empleó una metodología de revisión sistemática bajo el enfoque PRISMA (Preferred Reporting Items for Systematic Reviews and Meta-Analyses), mediante el análisis de múltiples fuentes y estudios previos que examinan la teoría de la imputación desde una perspectiva comparativa. Los hallazgos evidencian que las discrepancias interpretativas no solo conducen a decisiones contradictorias, sino que también impactan negativamente en la percepción social de la justicia. La conclusión central destaca la necesidad de establecer un marco normativo claro y coherente que permita armonizar las distintas interpretaciones, favoreciendo así la predictibilidad y la equidad en la aplicación del derecho penal. Este estudio proporciona una base sólida para futuras propuestas de reforma normativa y académica orientadas a mejorar la práctica judicial y fortalecer la confianza en el sistema legal.

The importance of this topic lies in the fact that divergent interpretations may undermine the administration of justice and generate legal uncertainty. The main objective of this article is to assess these doctrinal interpretations and their influence on judicial proceedings. A systematic review methodology was used, applying the PRISMA approach (Preferred Reporting Items for Systematic Reviews and Meta-Analyses), through the analysis of various sources and prior studies that examine the theory of imputation from a comparative perspective. The findings reveal that inconsistencies in interpretation not only lead to contradictory rulings but also negatively affect the public perception of justice. The most relevant conclusion of this study emphasizes the need to establish a clear and coherent normative framework that harmonizes the different interpretations of the theory, thereby promoting predictability and fairness in the application of criminal law. This research offers a solid foundation for future legal and academic reforms aimed at improving judicial practice and restoring trust in the legal system.
