Entre togas e poder: a justiça venezuelana no segundo mandato de Chávez

Abstract

Este artigo examina o processo de reconfiguração do Poder Judiciário venezuelano durante o segundo mandato de Hugo Chávez, com ênfase nas práticas institucionais e políticas que alteraram a dinâmica entre os Poderes da República. A partir da promulgação da nova Constituição, busca-se responder à seguinte questão central: de que forma o Poder Judiciário foi transformado no referido período? Nessa perspectiva, objetiva-se compreender os impactos dessa reconfiguração sobre a separação de poderes e sobre os fundamentos do Estado de Direito. A estrutura do trabalho compreende quatro seções analíticas: (i) as omissões do Judiciário frente à promulgação de leis; (ii) o avanço do controle político e o processo de desinstitucionalização; (iii) os desafios ao pluralismo decorrentes do domínio sobre os sistemas eleitoral e judicial; e (iv) as estratégias de fidelização institucional e aplicação de sanções seletivas por meio da Justiça. Além disso, são examinados episódios emblemáticos, como os eventos de abril de 2002, a utilização das listas “Tascón” e “Maisanta” (também referida como “Russian”) e práticas eleitorais como a “morocha” e o “ratónloco”. A pesquisa fundamenta-se em uma abordagem qualitativa, utilizando a revisão de literatura como procedimento metodológico para a construção do referencial teórico que orientaa análise crítica desenvolvida.

This article examines the process of reconfiguring the Venezuelan Judiciary during Hugo Chávez’s second presidential term, with an emphasis on the institutional and political practices that altered the balance among the branches of government. Starting from the promulgation of the new Constitution, the study seeks to answer the following central question: in what ways was the Judiciary transformed during this period? From this perspective, the objective is to understand the impact of this reconfiguration on the separation of powers and the foundations of the Rule of Law. The structure of the work comprises four analytical sections: (i) judicial omissions in the face of legislative enactments; (ii) the expansion of political control and the process of deinstitutionalization; (iii) the challenges to pluralism resulting from the domination of the electoral and judicial systems; and (iv) strategies of institutional loyalty and the selective application of sanctions through the judiciary. Furthermore, emblematic episodes are examined, such as the events of April 2002, the use of the “Tascón” and “Maisanta” (also known as “Russian”) lists, and electoral practices such as the “morocha” and the “ratónloco.” The research is based on a qualitative approach, using literature review as the methodological procedure to construct the theoretical framework that guides the critical analysis developed.
