Perspectiva ética de la adopción en el ecuador: instituciones humanas

Abstract

La investigación tiene como objetivo general analizar la ética de la adopción en el Ecuador como instituciones humanas. Tiene un diseño cualitativo con alcance descriptivo, la investigación es documental, sustentada en el método analítico. Las instituciones de contenido diverso (económico, social, jurídico, político, cultural), como es la adopción, deben estructurarse por medio de componentes éticos, pues se catalogan como ideales de lo que es correcto; en este sentido, los valores superiores del ser humano se plasmarían en figuras sensibles y de gran importancia. Se concluye, que en el sistema jurídico ecuatoriano existe, en efecto, una contradicción ética entre las disposiciones del Código de la Niñez y Adolescencia y las del Código Civil, en materia de adopción. Además, se recomienda enseñar a los estudiantes a identificar aquellas directrices éticas contradictorias, ya que es el alma máter es la que ofrece multiplicidad de corrientes universales de teorías y criterios éticos y humanos.

The general objective of the research is to analyze the ethics of adoption in Ecuador as human institutions. It has a qualitative design with a descriptive scope, the research is documentary, based on the analytical method. Institutions with a diverse content (economic, social, legal, political, cultural), such as adoption, must be structured through ethical components, since they are classified as ideals of what is correct; in this sense, the superior values of the human being would be reflected in sensitive figures of great importance. It is concluded that in the Ecuadorian legal system there is, in effect, an ethical contradiction between the provisions of the Code for Children and Adolescents and those of the Civil Code, regarding adoption. In addition, it is recommended to teach students to identify those contradictory ethical guidelines, since it is the alma mater that offers a multiplicity of universal currents of ethical and human theories and criteria.
