| dc.description | El presente artículo contentivo a las ciencias penales y criminológicas, tuvo como propósito fundamental analizar la autonomía del delito femicidio desde la óptica de la criminología. Una miranda con esencia de mujer y perspectiva de género, se sustentó bajo el paradigma interpretativo, enfoque cualitativo, orientado en la fenomenología, que interpreta y comprende los significados en los discursos de las personas. La técnica para la recolección de información fue la entrevista en profundidad y validación de expertos, dirigida a tres (03) profesionales un (01) Juez, un (01) Fiscal del Ministerio Público (01) Criminólogo. De acuerdo a los hallazgos obtenido se pudo concertar que el delito de femicidio es considerado como un delito autónomo e independiente a otro tipo penal y que su autonomía se refleja en el preámbulo de la Ley Orgánica sobre el Derecho de las Mujeres a una Vida Libre de Violencia, el aporte que le proporciona la criminología a este fenómeno es estudiar la víctima, el victimario así como también las causas como las consecuencia para que se materializara el mismo, contribuye a la Innovación investigativa, así como también en prevenir estos hechos, a objeto de evitar la victimización, la impunidad y tener acceso a la justicia. | es-ES |
| dc.description | The main purpose of this article, which is part of the criminal and criminological sciences, is to analyze the autonomy of the crime of femicide from the perspective of criminology. A look with the essence of woman and gender perspective was based on the interpretative paradigm, qualitative approach, oriented in phenomenology, which interprets and understands the meanings in the speeches of people. The technique for the collection of information was the in-depth interview and validation of experts, directed to three (03) professionals, one (01) Judge, one (01) Prosecutor of the Public Prosecutor's Office and one (01) Criminologist. According to the findings obtained, it was possible to agree that the crime of femicide is considered an autonomous and independent crime and that its autonomy is reflected in the preamble of the Organic Law on the Right of Women to a Life Free of Violence, The contribution that criminology provides to this phenomenon is to study the victim, the perpetrator as well as the causes and consequences for the materialization of the same, it contributes to the investigative innovation, as well as to prevent these facts, in order to avoid victimization, impunity and to have access to justice. | en-US |
