| dc.description | The general objective of this research was the analysis of the regulation of civil liability for damages caused by the usage of artificial intelligence in Venezuelan labor legislation. The Theoretical foundation was based on the postulates of key authors such as Sánchez & Gil (2018), Iturmendi (2020), Martínez & Salazar (2023) and Howarth, Chandler & Behrendt (2025), and relied on the analysis of fundamental legal instruments such as the Venezuelan Civil Code (1982), the Constitution (1999), the Organic Law on Prevention, Conditions and Environment of Work (LOPCYMAT) (2005), and the Organic Law on Labor, Workers and Workwomen (LOTTT) (2012). The research was of the documentary type. The population included normative legal texts, and as a technique of data collection, a documentary observation guide was used, which was validated by the Academic Committee of the Faculty of Legal and Political Sciences at the Universidad Privada Dr. Rafael Belloso Chacín. The results showed that the current legal regime is based on human fault (subjective liability), proving to be structurally insufficient to assign responsibility for autonomous AI decisions, despite the recognition of moral and material damage. It was determined that the attribution of liability must be facilitated against multiple actors in the AI's value chain, making it essential to identify the causal link, and an adaptation of LOPCYMAT was suggested with preventive mechanisms such as ethical audits. | dc.description | Esta investigación tuvo como objetivo general analizar la regulación de la responsabilidad civil por daños causados por el uso de la Inteligencia Artificial en la legislación laboral venezolana. La fundamentación teórica se sustentó en los postulados de autores clave como Sánchez y Gil (2018), Iturmendi (2020), Martínez y Salazar (2023) y Howarth, Chandler y Behrendt (2025), y se basó en el análisis de instrumentos legales fundamentales como el Código Civil de Venezuela, la Constitución (1999), la Ley Orgánica de Prevención, Condiciones y Medio Ambiente de Trabajo (LOPCYMAT) (2005) y la Ley Orgánica del Trabajo, los Trabajadores y las Trabajadoras (LOTTT) (2012). La investigación fue del tipo Documental. La población estuvo conformada por textos normativos legales, y como técnica de recolección de datos se utilizó la Guía de Observación Documental, instrumento validado por el Comité Académico de la Facultad de Ciencias Jurídicas y Políticas de la Universidad Privada Dr. Rafael Belloso Chacín. Los resultados arrojaron que el régimen jurídico vigente se sustenta en la culpa humana (responsabilidad subjetiva), resultando estructuralmente insuficiente para asignar responsabilidad ante las decisiones autónomas de la IA, a pesar de que se reconocen el daño material y moral. Se determinó que la atribución de responsabilidad debe ser facilitada contra múltiples actores en la cadena de valor de la IA, siendo indispensable identificar el nexo causal, y se sugirió adaptar la LOPCYMAT con mecanismos preventivos como las auditorías éticas. Por lo tanto, se concluyó que el marco legal, concebido en una era pre-digital, hace imperativa una reforma legal integral que garantice la protección efectiva de los trabajadores de Venezuela. | es |
