In Dubio Pro Reo Actuación de Miguel José Sanz como abogado defensor de un conspirador contra la Junta Suprema en 1810: El debido proceso o la propaganda revolucionaria

Abstract

A pesar de que la justicia que se impone en la naciente República venezolana en 1810 pretende diferenciarse al menos en el ámbito político de las leyes antiguas españolas, los juristas del nuevo proceso –como Miguel José Sanz- utilizan las viejas formas jurídicas del Derecho español no solamente para garantizar el debido proceso, incluso contra personajes acusados de actuar con violencia en contra de la Junta Conservadora de los Derechos de Fernando VII, sino también para difundir ante el mundo que el naciente Estado surgía con pleno respeto al Derecho y a las leyes.

Although the justice imposed in the nascent Venezuelan Republic in 1810, aims to differentiate itself at least in the political sphere from the old Spanish laws, the jurists of the new process -as is the case of Miguel José Sanz - use the old legal forms of Spanish law not only to ensure due process, even for those accused of acting violently against the Supreme Junta to Preserve the Rights of Ferdinand VII, but also to spread to the world that the nascent state is being birthed with full respect for the Law.
