dc.descriptionResumen:El crecimiento del transporte aéreo es un hecho importante para la economía mundial. El Convenio sobre Aviación Civil Internacional ha sido, desde sus inicios, instrumento jurídico para el crecimiento y desarrollo de la actividad. Con independencia de los principios invocados en el Preámbulo del citado convenio y del fracaso del Apéndice cuatro de la Convención de Chicago, los principios recogidos en el Acuerdo de Bermudas de 1946, condujeron el desarrollo de la actividad mediante acuerdos bilaterales que calificaron los derechos que los Estados se otorgaban mutuamente como Libertades del Aire. Conocer la naturaleza jurídica de tales libertades, su contenido y evolución hacia la globalización y liberación de mercados, obliga a replantearse el tema, para entender la realidad que afecta a los acuerdos aerocomerciales en la actualidad. Recurrimos al pensamiento del ilustre maestro argentino, Enrique Ferreira, para examinar el tema y evaluar el producto obtenido que ha conducido a situaciones oligopólicas, contrarias a la filosofía y principios que consagra el Convenio sobre Aviación Civil Internacional.Palabras Clave: Obligación, libertad, norma internacional, cumplimiento, equidad y vigencia de los acuerdos internacionales.Abstract:Air transportation growth is an important factor for the world's economy. The International Civil Aviation Convention has been, from its beginnings, a legal instrument for the activity's development and growth. Independent of the principles invoked in the Preamble of said convention and, of the failure of the Fourth Appendix of the Chicago Convention, the principles found in the Bermuda Agreement of 1946 led to the development of the activity by means of bilateral agreements that qualified the rights mutually given between States as Freedoms of the Air. Knowing the legal nature of such freedoms, their content and evolution towards globalization and market liberalization, makes it necessary to rethink the issue to understand the reality that affects current commercial agreements. We resort to the illustrious Argentine expert, Enrique Ferreira, to examine the topic and evaluate the product that has led to oligopolic situations, which are contrary to the philosophy and principles that consecrates the International Civil Aviation Convention.Key Words: Commitment, freedom, international standard, fulfillment, equality and international agreements validity.es-ES
