LA CULPABILIDAD Y RESPONSABILIDAD COMO CATEGORÍAS DE INTERPRETACIÓN EN LA OBRA DE CLAUS ROXIN
Resumen
El presente trabajo tiene por finalidad, hacer un análisis del pensamiento del autor Claus Roxin, sobre las categorías sistemáticas de la culpabilidad y responsabilidad. Se aborda el estudio sociohistórico que hace el autor, de las teorías de la penas. Se revisan los criterios de autores como: Von Liszt, Reinhard Frank, Hans Welsel y Ghunter Jakobs, sobre los conceptos de responsabilidad y culpabilidad.asi mismo, se realiza un análisis comparativo entre Roxin y Jakobs; sobre los criterios mas importantes de sus posiciones doctrinarias. Igualmente se esbozan las aproximaciones interpretativas de este estudio. This paper aims to analyze Claus Roxin’s thought on the systematic categories of guilt and responsibility. The social historical study done by this author on the theories of punishment is addressed. Criteria from authors such as Von Liszt, Reinhard Frank, Hans Welzel and Günter Jakobs on the concepts of responsibility and guilt are reviewed. Similarly, a comparative analysis is done using the most significant criteria of Roxin and Jakobs doctrinal positions. Also, interpretative approaches are drawn
