LA JUSTICIA Y SU REALIZACIÓN COMO PRINCIPIO, CAUSA Y ELE-MENTO DEL DERECHO: UNA MIRADA A LA LUZ DE LA CONCEP-CIÓN ROMANA DE IUS

Abstract

En las siguientes líneas se reflexionará sobre la justicia como principio, fun-damento y fin del derecho; y de la norma jurídica, la coerción y la coacción como sus elementos constitutivos, orientado dicho análisis por el concepto romano de ius, atribuido a Celso, y por la tesis del jurista alemán Ihering, para quien el dere-cho es un interés jurídicamente tutelado que resume las condiciones necesarias para preservar la vida, la existencia moral de las personas y la sociedad toda, realizable a través de las normas y el poder coactivo del Estado. Así las cosas y siguiendo la concepción romana del ius, “lo justo” o lo que es lo mismo, lo “bueno y equitati-vo”, es el principio desde el cual y para el cual ha nacido el derecho, el fundamento que lo orienta y delimita; y el fin último que lo mueve a hacerse en busca de la perfección y el bien.

Through the following lines we will develop an insight about justice as a principle, foundation and goal of the law; and about the legal rule, coercion and coaction as its constituent elements. This analysis will be addressed by the Roman concept of ius -which has been attributed to Celso-, and by the thesis of the Ger-man jurist Ihering, who considered law as a legally protected interest that sums up the necessary conditions to preserve life, moral existence of people and therefore the whole society, being achievable through the rules and the coercive power of the State. Under the Roman conception of ius, "what is fair" or the "good and equita-ble" is the principle from which and for which law has been born; the foundation that guides it and delimits it; and the ultimate goal that moves it to the search of perfection and good.
