LA TRANSFIGURACIÓN CONSTITUCIONAL EN LA CONVOCATORIA DE LA ASAMBLEA NACIONAL CONSTITUYENTEDE VENEZUELA DEL 2017.

Abstract

La libertad ciudadana es aquella reconocida por las leyes vigentes en una determinada época y espacio, por ello tanto la libertad como el ejercicio del poder se encuentran sometidos al imperio de la ley, siendo la libertad la inmunidad que posee el ciudadano ante el abuso del ejercicio del poder del gobernante. Por ello, la Constitución, como cuerpo normativo, debe fungir como freno al abuso de poder y protección de libertades. Con la instalación de la Asamblea Nacional Constituyente en Venezuela en el año 2017 a iniciativa del Presidente Nicolás Maduro Moros, sustentado en las decisiones dictadas por la Sala Constitucional del Tribunal Supremo de Justicia, sin referéndum consultivo previo a la ciudadanía, se ha trasfiguradola Constitución vigente, lo que genera como consecuencia que el proyecto de constitución que elabore la Asamblea Nacional Constituyente instalada en tal forma, se convierta en una Constitución otorgada desde el ejercicio del poder y no en una Constitución democrática sustentada en la participación y aprobación del pueblo.
