LA JURISDICCIÓN DE LOS PUEBLOS INDÍGENAS EN EL ORDENAMIENTO JURÍDICO VENEZOLANO

Abstract

Es una investigación que consistió en determinar el reconocimiento de la jurisdicción indígena, con normas que integran el ordenamiento jurídico venezolano y las competencias de las autoridades legítimas en la aplicación de justicia. Es relevante para el conocimiento de abogados, de integrantes de dichas comunidades como de investigadores. Al lado de la jurisdicción ordinaria administrada por los jueces de instancia, coexiste una jurisdicción especial que es ancestral trasmitida de generación en generación siendo un derecho consuetudinario. Se concluye que el constituyente venezolano hace justicia, al Constitucionalizar los Derechos y reconocer la Jurisdicción Indígena de un sector de la población venezolana, que no tenían ningún tipo de valoración ni reconocimiento en el ordenamiento jurídico venezolano anterior a la Constitución de la República Bolivariana de Venezuela del año 1999.

It is an investigation that consisted in determining the recognition of the indigenous jurisdiction, with norms that integrate the Venezuelan legal system and the competences of the legitimate authorities in the application of justice. It is relevant to the knowledge of lawyers, members of such communities as researchers. Beside the ordinary jurisdiction administered by the trial judges, a special jurisdiction coexists which is ancestral transmitted from generation to generation being a customary law. It is concluded that the Venezuelan constituent does justice, to Constitutionalise the Rights and to recognize the Indigenous Jurisdiction of a sector of the Venezuelan population, that did not have any type of valuation or recognition in the Venezuelan legal system previous to the Constitution of the Bolivarian Republic of Venezuela Of the year 1999.
