La acción de amparo como vía para controlar las decisiones tomadas en el procedimiento de impugnación de asambleas del artículo 290 del Código de Comercio

Abstract

In this research is established the provenance of the Writ o.lAmparo as a method for the control of the decisions taken by the judge in the mercantile procedure about the chal1enging of corporate assemblies. This is the main reason why the viability, relevance and effectiveness are studied in this paperwork to find out about their pertinence. The control of these decisions is of great importance in order to guarantee the smooth running of the trade companies, due to its pronounced infiuence in the nation's economy; because if they go through any negative situation, it will negatively affect the economic development of the country. This research followed the documentary design, with a deep study of bibliographic and documentary sources. The documentary and qualitative method are used as well, starting with the revision of the literature represented by: laws, books of specialists on matters related to the study, as the jurisprudence on the matter. The deductive method is also applied, going from the general to the particular issues. The analysis of logical interpretation is used to analyze the information. The descriptive level of research allowed emphasizing the most relevant aspects of the researched topic, coming to conclusions on the issue under investigation.

El presente trabajo de investigación intentará establecer la procedencia de la acción de amparo como medio de control de las decisiones tomadas por el Juez Mercantil en el procedimiento de impugnación de asambleas societarias, de aquí que su buscará su viabilidad, vigencia y eficacia. El control de estas decisiones tienen gran importancia debido a que hay que garantizar la buena marcha de las compañías de comercio, debido a su gran influencia en la economía de la nación, de aquí, que lo que le pase negativamente a éstas, marcará negativamente el desarrollo económico integral del país. El presente estudio monográfico será documental, con estudio profundo de fuentes bibliográficas y documentales. Utilizando el método documental y cualitativo, tomado como partida, la revisión de la bibliografía representada por: leyes, libros de especialistas sobre las materias relacionadas con el estudio, así como, la jurisprudencia al respecto. El instrumento a utilizar, será una matriz fundamental que permitirá analizar el contenido de la información, que se extraerá de las fuentes bibliográficas, documentales y jurisprudenciales. Se aplicará el método deductivo, de lo general a lo particular. Se ejecutará el análisis de interpretación lógica, para analizar la información. El nivel de investigación será descriptivo, escudriñando los aspectos más relevantes del tema investigado, llegando a las conclusiones sobre el tema investigado.
