Evolución normativa de la familia en el Ecuador frente a los Derechos Humanos

Abstract

Con el objetivo de comprender la evolución de la institución familiar en el contexto del Ecuador, el estudio incursiona en el análisis de los factores que han conllevado la modificación normativa de la familia. La metodología aplicada ha sido pensada desde la comprensión de aquellos fenómenos sociales que han venido a trastocar esta institución, en articulación con el método hermenéutico para el análisis de la Constitución, normativa secundaria nacional, internacional y jurisprudencia. El estudio desarrollado permite concluir que la institución familiar ha sido redefinida en atención a nuevas realidades de la sociedad, que se enlazan con el empoderamiento de las personas sobre sus propios derechos humanos y promueve la aceptación de la diversidad, incluso en sociedades cerradas, lo que deja sentada la percepción sobre una institución abierta a una evolución continua.

With the objective of understanding the evolution of the family institution in the Ecuadorian context, the study ventures into the analysis of the factors that have led to the normative modification of the family. The applied methodology has been thought from the understanding of those social phenomena that have come to disrupt this institution, in articulation with the hermeneutical method for the analysis of the Constitution, secondary national, international regulations and jurisprudence. The study carried out allows us to conclude that the family institution has been redefined in response to new realities in society, which are linked to the empowerment of people over their own human rights and promote the acceptance of diversity, even in closed societies, which that leaves the perception of an institution open to continuous evolution.
